Twisted Pizza – SMS/MMS Mobile Message Marketing Program Terms & Conditions

Twisted Pizza (“we,” “us,” “our”) offers a mobile messaging program (the “Program”), which you agree to use and participate in subject to these Terms & Conditions and our Privacy Policy (collectively, the “Agreement”). By opting into or participating in the Program, you agree to these terms, including the binding arbitration clause in the “Dispute Resolution” section below. This Agreement is specific to the Program and does not alter any other agreements you may have with us.

User Opt-In

By signing up through online forms, in-person at one of our locations, or any other method, you agree to receive recurring SMS or MMS messages from Twisted Pizza. You understand that your consent is not a condition of purchase. Message and data rates may apply. Not all messages are sent using an autodialer, but your consent applies regardless.

User Opt-Out

To stop receiving messages, reply with STOP, END, CANCEL, UNSUBSCRIBE, or QUIT. You may receive one confirmation text after opting out. Any other method (including telling a staff member) is not a valid way to opt out.

Duty to Notify and Indemnify

If you change your mobile number, cancel your service, or transfer your phone, you must opt out beforehand. Failure to do so may result in legal or financial consequences, including your responsibility for any claims made by someone who later receives messages intended for you.

Our mobile messages include promotions, specials, events, or other marketing communications related to Twisted Pizza and our locations.

Message frequency varies based on user interaction. Standard message and data rates apply. You may receive multiple texts per month.

MMS Disclosure

If your phone doesn’t support MMS, you’ll receive SMS instead.

Disclaimer of Warranty

This Program is provided “as is.” We are not responsible for any delivery failures, delays, or service issues caused by your wireless provider or carrier.

Participant Requirements

You must be at least 13 years old, have a text-capable phone, and subscribe to a supported wireless carrier.

Age Restriction

Users under 13 are not allowed. Users aged 13–17 must have permission from a parent or guardian.

Prohibited Content

You agree not to send content via the Program that is:

Unlawful, abusive, or harassing
Discriminatory or offensive
Malicious code or viruses
Related to protected health information (HIPAA)
Prohibited by law in your jurisdiction

Dispute Resolution

All disputes will be resolved through binding arbitration in Rhode Island under the rules of the American Arbitration Association. No class actions or jury trials permitted. Each party pays its own arbitration fees unless otherwise ordered.
